These terms govern your use of www.republicafrica.co and all associated platforms, publications, and events operated by Republic Africa.

Legal Agreement

By accessing, browsing, subscribing to, or participating in any service, website, platform, publication, event, or product under the Republic Africa brand (including republicafrica.co), you agree to be legally bound by the following terms and conditions:

  • All content and services are provided “as is” for informational and promotional purposes. We do not warrant accuracy, reliability, or suitability for any purpose.
  • Republic Africa, its employees, affiliates, contractors, and agents shall not be held liable for any loss, damage, injury, or claim resulting from your use of our platforms or participation in our events or content.
  • You explicitly agree to indemnify and hold harmless Republic Africa, its officers, partners, staff, and affiliates from any legal claim or liability arising from your interaction with our platforms, digital or physical.
  • Participation in any event hosted or managed by Republic Africa implies full acceptance of these terms and that you waive any right to sue Republic Africa or any party involved in producing said event.
  • Republic Africa reserves the right to update or change these terms at any time without prior notice.
  • You agree that any legal dispute will be governed by the jurisdiction of the Republic of South Africa.

User Generated Content and Copyright Policy

Our commitment
Republic Africa respects intellectual property rights and expects users and partners to do the same. We will respond to notices of alleged copyright infringement in accordance with applicable law. Where a notice is complete and verified, we will act promptly and will remove or disable access to the identified content as quickly as practicable and in any case within 7 days of receipt.

Scope
This policy applies to user generated content and externally supplied materials that appear on any site, app, social profile or channel controlled by Republic Africa and affiliated brands.

How to send a copyright notice
Email clients@republicafrica.co.za  with the subject line: Copyright Notice. Your notice must include:

  1. Your full name, organisation if applicable, postal address, email address and telephone number.

  2. Clear identification of the copyrighted work you claim is infringed. Include registration details if available.

  3. The exact URL or location of the material you claim is infringing on our site or channels.

  4. A statement that you have a good faith belief that the disputed use is not authorised by the rights holder, its agent or the law.

  5. A statement that the information in your notice is accurate and that you are the rights holder or authorised to act on the rights holder’s behalf.

  6. An electronic or physical signature of the rights holder or authorised agent.

Template statement
“I declare that the information in this notice is true and complete to the best of my knowledge and that I am the copyright owner or authorised to act on the owner’s behalf. I have a good faith belief that the use of the material in the manner complained of is not authorised by the owner, its agent or the law.”

What we do when we receive a notice

  1. Review the notice for completeness and verify the claim.

  2. Where appropriate, remove or disable access to the identified content promptly and in any case within 7 days of receiving a complete and verified notice.

  3. Notify the uploader or supplying party, where identifiable.

  4. Invite a counter notice from the uploader, where relevant.

Counter notice
If you believe content was removed in error, reply to our notification with a counter notice that includes your contact details, the URL of the material that was removed, and a brief explanation of why you believe you have the right to use the material. We may reinstate content at our discretion after assessing the information provided.

Third party suppliers and user submissions
Where content is supplied by users or third parties, we may have relied on assurances that they had rights to provide the material. If you are the rights holder and believe your content has been used without permission, notify us using the process above. We will remove or disable access promptly and in any case within 7 days of receiving a complete and verified notice.

Pre-litigation notice and resolution window
Before commencing any legal claim relating to user generated content or copyright on our services, you agree to send a written notice to Republic Africa at the email above and allow up to 7 days for us to investigate and resolve the matter. This clause does not limit any non-excludable rights you may have under applicable law.

Limitation of liability
To the maximum extent permitted by law, Republic Africa and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with user generated content or the removal or disabling of content under this policy. To the maximum extent permitted by law, our total aggregate liability for all claims relating to this policy will not exceed the greater of R1,00 or the total fees, if any, you paid to us for the specific service in the 12 months before the event giving rise to the claim.

Indemnity
You agree to indemnify and hold harmless Republic Africa and its affiliates from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in any way connected with content you submit or supply to us.

Governing law and venue
This policy and any dispute arising out of it are governed by the laws of the Republic of South Africa. You agree to the exclusive jurisdiction of the courts located in Johannesburg, Gauteng, subject to any mandatory consumer protection rights that apply.

No admission of liability
Actions taken under this policy are carried out without prejudice and do not constitute an admission of liability.

Severability
If any provision of this policy is found unenforceable, the remaining provisions will remain in full force and effect.
